Uptown Cheapskate Franchise System LLC ("Company," "we," "our," or "us") is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you interact with our services, including our websites, our in-store check-in kiosks, our mobile applications, and our SMS/text messaging and email programs (collectively, the "Services").

Uptown Cheapskate stores are independently owned and operated by local franchisees. This policy describes practices common across the Services; an individual store may have additional practices.

By using the Services, you agree to this Privacy Policy. Where required by law, we obtain your consent separately (for example, for marketing text messages).

Information you provide

Payment information

Card payments are processed by our third-party payment processor. The processor collects and manages your card number, billing details, and transaction information. We and our stores do not have access to or store your payment card information, including the card number or any portion of it.

Information collected automatically

When you use our websites or app, we automatically collect usage information through cookies, web server log files, and similar technologies, including IP address, device and browser information, the date and time of visits, the pages viewed, and the pages visited just before and just after our site. See Section 8 (Cookies and Tracking Technologies).

Surveys and contests

If you participate in an optional survey or contest, we may collect contact and demographic information (such as zip code or age range) to administer it.

We send both account/transactional messages and, separately, marketing and promotional messages, by SMS and email.

SMS. Messages are delivered through our third-party messaging service providers using automated technology. You may opt out of marketing text messages at any time by replying STOP; account/transactional and security messages may continue where permitted as part of providing the Services. Consent to marketing texts is not a condition of any purchase or sale.

Email. We send both transactional emails (such as account, transaction, or service notifications) and marketing emails (such as promotions and offers). You may unsubscribe from marketing emails using the link in any such email; transactional emails may continue as part of providing the Services.

5. How We Share Information

We do not sell your personal information. We share personal information only as follows:

6. Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your personal information (see Section 9). We will honor deletion requests, except that we may be required to retain certain records — such as seller and transaction records under secondhand-dealer laws — for a period set by the store's local jurisdiction. When retention is no longer necessary, we securely delete or anonymize the data.

Your information is stored and processed in the United States. We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Our websites and app use cookies and web server log files to distinguish users, support security and login, and measure aggregate usage so we can improve the Services. Cookies do not retrieve other data from your device and cannot carry viruses. Most browsers accept cookies by default; you may set your browser to refuse cookies, although some features may not function properly as a result.

California residents (CCPA/CPRA)

If you are a California resident, you have the right to: know the categories and specific pieces of personal information we collect, use, and disclose; request deletion of your personal information; request correction of inaccurate information; and opt out of the "sale" or "sharing" of personal information, to the extent any occurs. We will verify your request before responding, consistent with law, and you may use an authorized agent.

Other states

Residents of other states may have similar rights under their own state privacy laws.

10. Children's Privacy

Our Services are intended for adults. You must be at least 18 years of age to create an account or sell items through the Services, and minors may use the Services only through a parent or legal guardian. We do not knowingly collect personal information from children under the age of 13, and our Services are not directed to them. If we learn that we have inadvertently collected information from a child under 13, we will promptly delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where required or where you have opted in, notify you. We will not use previously collected personal information in a manner materially inconsistent with the policy under which it was collected without your consent.
